The legal battle surrounding the demand response industry is heating up as the Federal Energy Regulation Committee filed a Supreme Court challenge saying that its earlier ruling misinterpreted federal law.

The court's previous ruling stripped the Committee of its power to regulate demand response in wholesale energy markets, stating that such regulation is under state, not federal, jurisdiction. The ruling also raised the question of the Committee's power to regulate the participation of retail energy customers in wholesale capacity markets.

Among other complaints, the Committee pointed out that its role is to ensure that wholesale electricity rates are "just and reasonable." Since demand response participation affects these rates, it should be under their power to regulate demand response.
